Knowingly leaving the scene of an accident

John Alfred Empey, 69, resident of 11048 Cullimer Lane, Thacter, Utah, was indicted on May 15 on the charge of knowingly leaving the scene of an accident (resulting in death).

According to the indictment, on or about Dec. 11, 2007, Empey drove a motor vehicle involved in an accident resulting in the death of a man and Empey knowingly failed to stop or immediately return to the scene of the accident.

Criminal sexual penetration

of a minor (two counts)

Tim Lerma, 56, resident of Zonie Way, Santa Fe, was indicted on May 15 on two charges of criminal sexual penetration of a minor (child under 13 years old).

According to the indictment, on or about March 2, Lerma committed fellatio on a boy 12 years old or younger. Lerma also touched or applied force to the unclothed intimate parts of the boy.

Aggravated driving while under the influence of intoxicating liquor

Ray Manuel Hernandez, 34, resident of 832 Third Street, Rio Rancho, was indicted on May 15 on the charge of aggravated driving while under the influence of intoxicating liquor (refusal).

According to the indictment, on or about March 5, Hernandez operated a motor vehicle while under the influence of an intoxicating liquor or a drug to a degree that he was incapable of safely driving a vehicle and he refused to submit to chemical testing as provided in the Implied Consent Act.

Residential burglary (three counts), larceny (three counts)

Christopher J. Smith, 42, resident of 630 Pecos Loop, Rio Rancho, was indicted on May 15 on three charges of residential burglary and three charges of larceny (over $500).

According to the indictment, on or about Feb. 1, Pecos entered a house in the 2700 block of Vista de Colinas Place in Rio Rancho without permission, with the intent to commit burglary or theft once inside. Smith took miscellaneous appliances that had a market value exceeding $500.

Smith entered a house on or about Feb. 13 in the 2100 block of Vista de Colinas Place in Rio Rancho without permission, with the intent to commit burglary or theft once inside. Smith took miscellaneous appliances that had a market value exceeding $500, according to the indictment.

Smith entered a house in the 1600 block of Western Hills Drive in Rio Rancho on or about Feb. 21 without permission, with the intent to commit burglary or theft once inside. Smith took miscellaneous appliances that had a market value exceeding $500, according to the indictment.

Aggravated driving while under the influence of intoxicating liquor or drugs, driving while license suspended or revoked

Michael Voight, 39, resident of 110 Darlene Road, Rio Rancho, was indicted on May 15 on charges of aggravated driving while under the influence of intoxicating liquor or drugs (refusal) and driving while license suspended or revoked.

According to the indictment, on or about May 4, Voight operated a motor vehicle while under the influence of an intoxicating liquor or a drug to a degree that he was incapable of safely driving a vehicle and he refused to submit to chemical testing as provided in the Implied Consent Act. Voight also drove a motor vehicle on a public highway when his privilege to do so was revoked or suspended.

Residential burglary, theft of credit card (seven counts), receiving stolen property (three counts)

John Michael Melger, 31, resident of 711 Stagecoach Road, Rio Rancho, was indicted on May 15 on the charges of residential burglary, seven counts of theft of credit card and three counts of receiving stolen property (retain) (over $250)

According to the indictment, on or about Feb. 1, Melger entered a house in the 700 block of Stagecoach Road, Rio Rancho, without authorization or permission, with the intent to commit a felony or theft once inside. Melger took a Mervyn’s credit card, two Salute credit cards, an HSBC credit card, two Capital One credit cards and a Merrick Bank credit card.

According to the indictment, Melger also kept prescription medication, which had been stolen, and he knew or believed that it had been stolen. The medication’s value exceeded $250. Melger kept tax paperwork in the name of a couple, which had been stolen, and he knew or believed it had been stolen.

    " On August 28Th 2008 at approx 9 ;15 am i was at Smith"s doing some grocery shopping. After going to the bank and getting my rent money out. Well getting out of my car i dropped my wallet and i want to thank whoever turned it in to the smiths Mgr BUT i hope the 350.00 you STOLE out of it {which was my rent money} you spend it wisely... and i hope you never lose your money cause you will know then the hurt you caused my family.. enjoy it while it last "
