Aggravated battery against a household member, tampering with evidence, possession of marijuana

Eric Gardner, 22, resident at 5501 Rabadi Castle NW, Albuquerque, was indicted on March 27 on charges of Aggravated battery against a household member (deadly weapon), which is a fourth degree felony (minimal sentence of 18 months and a fine not to exceed $5,000.) Gardner also was indicted on charges of tampering with evidence and possession of marijuana (one ounce or less), which are misdemeanors (minimal sentence of six months and a fine not to exceed $500).

On or about Feb. 23, Gardner assaulted a female household member with a knife, a deadly weapon or an instrument or object which, when used as a weapon, could cause death or very serious injury.

Gardner also destroyed/changed/hid/fabricated/placed marijuana with the intent to prevent the apprehension, prosecution or conviction of himself, or create the false impression that another person had committed a crime.

Gardner knowingly and intentionally possessed one ounce or less of marijuana.

Criminal sexual penetration in the second degree, incest

Anthony Ross Jr., 48, resident at 303 Oreja De Oro Drive, Rio Rancho, was indicted on March 27 on charges of six counts of criminal sexual penetration in the second degree (force or coercion n child 13 to 18 years old), which is a second degree felony (minimal sentence of nine years and a fine not to exceed $12,500). Ross also was indicted on six counts of incest, which is a third degree felony (minimal sentence of three years and a fine not to exceed $5,000).

On or between Sept. 1, 2004 and Dec. 1, 2005, Ross engaged a family member between the age of 13 to 18 in sexual intercourse, by the use or force of coercion and Fellatio by the use or force of coercion

In November of 2006, Ross again engaged a family member between the age of 13 to 18 in sexual intercourse, by the use or force of coercion

Around Dec. 29, 2006, Ross engaged a family member between the age of 13 to 18 in sexual intercourse, by the use or force of coercion and Fellatio by the use of force or coercion.

Charles Hilgeford, 65, resident at 3604 Cresent Avenue, Farmington, was indicted on March 27 on charges of criminal sexual penetration in the second degree (force or coercion n child 13 to 18 years old), which is a second degree felony (minimal sentence of nine years and a fine not to exceed $12,500). Ross also was indicted on six counts of incest, which is a third degree felony (minimal sentence of three years and a fine not to exceed $5,000).

On or about Aug. 10, 2006, Hilgeford caused a family member to engage in sexual intercourse, by the use of force, or coercion on a child.

Embezzlement

Elizabeth Scobee, 27, resident at 6957 Concord Hills Loop, Albuquerque, was indicted on March 27 on charges of embezzlement (over $500), which is a third degree felony (minimal sentence of three years and a fine not to exceed $5,000.).

On or about May 7, 2007, Scobee converted to her own use money orders which had a market value over $500, and with which the defendant had been entrusted, with intent at the time of conversion to fraudulently deprive the owner of her property.
