Aggravated Battery

Michael Gallegos, 29, resident of 4537 Ambrose Allday SE, Rio Rancho, was indicted on March 20 on a charge of aggravated battery, which is a third degree felony (three year minimal sentence and a fine not to exceed $5,000).

Gallegos was arrested on or about Oct. 21, 2007 when he touched or applied force to another person, intending to injure that person or another, and caused great bodily harm, or acted in a way that would likely result in death or great bodily harm to the victim.

Residential Burglary, Larceny (Over $2,500)

Vincent Barreras, 26, resident of 3120 Barboa SW, Albuquerque, was indicted on March 20 on a charge of residential burglary and larceny (over $2,500). Both are third degree felonies (three year minimal sentence and a fine not to exceed $5,000).

Barreras was arrested on or about June 7, 2007 when he entered another person’s house, located at 11 Camino De Santiago, without authorization or permission, with intent to commit residential burglary, or theft when he got inside.

On or about June 7, 2007, Barreras took the victim’s tools and rims, which had a market value exceeding $2,500. Barreras intended to permanently deprive the victim of it.

Residential Burglary, possession of burglary tools, receiving stolen property (over $2,500)

Christopher Smith, 44, resident of 630 Pecos Loop, Rio Rancho, was indicted on March 20 on two counts of residential burglary, which are third degree felonies (three year minimal sentence and a fine not to exceed $5,000).

Possession of burglary tools and receiving stolen property (over $2,500), which are fourth degree felonies (18-month minimal sentence and a fine not to exceed $5,000.)

On or about March 6, Smith entered a home without authorization or permission with intent to commit residential burglary, or theft when he got inside. Smith had burglary tools in his possession and he intended to use the tools to commit a burglary. Smith also kept stolen property, knowing or believing that it had been stolen and it had a market value exceeding $500.

Aggravated Assault (deadly weapon) (firearm enhancement)

Daniel Grunstad, 55, resident of 861 Camino Isabella, Bernalillo, was indicted on March 20 for aggravated assault (deadly weapon) (firearm enhancement), which is a fourth degree felony (minimal sentence of 18 months and fine not to exceed $5,000). The firearm enhancement increases the penalty by a year.

On or about March 8, Grunstad assaulted another person with a black revolver handgun, a deadly weapon or an instrument or object which, when used as a weapon, could cause death or serious injury.

Possession of a controlled substance (methamphetamine), possession of a controlled substance (cocaine)

James Conn, 51, resident at 1040 Meadowlark Court, Rio Rancho, was indicted on March 20 for possession of a controlled substance (methamphetamine) and possession of a controlled substance (cocaine), which are both fourth degree felonies (minimal sentence of 18 months and a fine not to exceed $5,000).

On or about Dec. 2, 2007, Conn intentionally had in his possession Methamphetamine, a narcotic drug which is a Schedule I or II controlled substance, or phencyclidine or analog of phencyclidine or methamphetamine, its salts, isomers, salts of isomers or an analog of such, knowing or believing it to be Methamphetamine, or believing it to be some drug or other substance the possession of which is regulated or prohibited by law.

Conn also had cocaine in his possession.
